Toby specialises in disputes about wills, trusts, inheritance and property, especially disputes where issues of mental capacity, taxation, undue influence or financial irregularity arise.
Toby is a Fee-Paid Judge of the First-tier Tribunal (Health, Education and Social Care Chamber) and a full member of STEP.

Toby specialises in disputes about wills, trusts, inheritance and property, especially disputes where issues of mental capacity, taxation, undue influence or financial irregularity arise. He is a full member of STEP.
Toby has a degree in Mathematics. This provided him with the analytical and numerical skills to understand technical legal and financial problems. He regards that as half his job. The other half, which he enjoys equally, is getting to know his clients and understand their requirements, and working with them to vindicate their rights, whether via advocacy in court or negotiated settlement.
Wills, Trusts, Inheritance and Property
Toby’s practice includes probate disputes, TOLATA claims and Inheritance Act claims. He also advises clients on the interpretation and effect of wills, trusts and conveyances of land, and on disputes involving issues of mental capacity, taxation, fraud, negligence and insolvency.
His property practice includes easement and boundary disputes, commercial possession and lease renewal claims, Leasehold Enfranchisement claims, dilapidations claims, and applications to the First-tier Tribunal (Property Chamber).
Toby also represents and advises local authorities, social landlords and tenants in residential property disputes, including possession claims, ASBI claims, Equality Act Claims, disrepair claims, homelessness appeals, and judicial review claims.
Mental Capacity Law
Toby represents family members, local authorities, NHS bodies and other interested parties in health and welfare and property and affairs applications in the Court of Protection. His cases include contested deputyship applications, the use and abuse of powers of attorney, disputes as to care and medical treatment, and the use of the deprivation of liberty safeguards.
Toby is currently the joint Head of Chambers together with Amanda Rhodes
