Toby specialises in property law and public law. He regularly appears in the County Court and High Court and particularly enjoys cases of legal and factual complexity.
Toby is also a Fee-Paid Judge of the First Tier Tribunal (Health, Education and Social Care Chamber).
He is known as an incisive advocate who is skilled at dissecting technical issues and presenting them in the simplest and clearest terms. He enjoys working as part of a team to achieve the best possible result for the client.
Toby has a particular expertise in social housing law and is regularly instructed by leading solicitors in this field.
He delivers lectures and training seminars in all his fields of practice and is happy to tailor these to suit individual requests.
Property and Commercial Chancery Law
Toby’s private client practice includes TOLATA claims, co-ownership disputes, probate disputes and Inheritance Act claims. He is a full member of STEP.
He regularly advises lay and professional executors on issues arising in estate administration and has extensive experience of claims involving allegations of fraud and undue influence.
His commercial property practice includes all manner of claims under the Landlord and Tenant Act 1954, dilapidations claims and leasehold enfranchisement claims.
Toby’s first degree was in Mathematics and he is at ease with cases involving complex financial issues. He advises and represents clients in relation to sale and supply of goods claims, consumer claims, partnership and joint venture disputes, winding-up petitions and related insolvency proceedings, and agency and guarantee disputes.
Housing, Homelessness and Anti-social behaviour law
Toby represents local authorities, social landlords and tenants.
He represents and advises clients in relation to possession claims (in which he is regularly instructed on appeal, particularly in cases involving public law or discrimination defences), cases concerning travellers’ rights, injunctions (for example ASBIs and gas injunctions), disrepair claims, section 204 homelessness appeals and judicial review claims.
He has a comprehensive knowledge of the over-arching legal and regulatory framework and advises social landlords in relation to policy and governance issues.
Court of Protection
Toby represents family members, local authorities and other interested parties in property and affairs disputes and also in health care and welfare cases.
His experience includes contested deputyship applications, the use and abuse of powers of attorney, disputes as to care and medical treatment, and the use of the deprivation of liberty safeguards.
Toby is currently the joint Head of Chambers together with Amanda Rhodes
